These Terms of Service constitute a legally binding agreement. By using North Lucid's website and services, you agree to all terms outlined below. Please read them carefully before making any purchase.
By accessing, browsing, or using the North Lucid website located at northlucid.com (the "Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Returns & Refund Policy, all of which are incorporated herein by reference. If you do not agree with any provision of these Terms, you must immediately cease all use of the Site and its services. North Lucid reserves the right to modify these Terms at any time by posting the revised version on the Site. Your continued use of the Site following such modifications constitutes your acceptance of the updated Terms. We recommend reviewing these Terms periodically.
You must be at least nineteen (19) years of age to access this Site, create an account, or purchase any products. By using the Site, you represent and warrant that you are at least 19 years old and that you have the legal capacity to enter into a binding agreement. North Lucid employs an age verification gate upon first visit. We reserve the right to request additional proof of age at any time, including but not limited to government-issued identification. Any order placed by a person under the age of 19 will be cancelled and refunded, and the associated account may be terminated. It is a violation of these Terms to misrepresent your age.
Psilocybin mushrooms are classified as a controlled substance under the Controlled Drugs and Substances Act (CDSA) in Canada. By using this Site and purchasing products, you acknowledge and accept all legal risks associated with the purchase, possession, and consumption of psilocybin-containing products. North Lucid operates in a legal grey area and makes no representations or warranties regarding the legality of its products in your specific jurisdiction. You are solely responsible for understanding and complying with all applicable federal, provincial, and municipal laws in your area. North Lucid shall not be held liable for any legal consequences arising from your purchase or use of our products. North Lucid makes reasonable efforts to accurately describe all products, including strain type, potency, weight, and effects. However, natural products may vary in appearance, potency, and effects between batches. Product images are for illustrative purposes only and may not represent the exact product received. All prices are listed in Canadian Dollars (CAD) and include applicable taxes unless otherwise stated. Prices are subject to change without prior notice. Promotional pricing, discount codes, and special offers are valid only for the specified duration and may be subject to additional terms. We reserve the right to correct any pricing errors, even after an order has been placed. In such cases, you will be notified and given the option to proceed at the corrected price or cancel the order for a full refund.
All orders placed through the Site are subject to acceptance by North Lucid. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including but not limited to orders that appear fraudulent, exceed reasonable personal-use quantities, or violate these Terms. Payment must be completed at the time of purchase using one of our accepted payment methods (credit card via Stripe or Interac e-Transfer). Orders are not confirmed until payment has been successfully processed and you receive an order confirmation. We aim to process and ship orders within 1-2 business days. During peak periods, processing times may be longer. Order modifications or cancellations may be requested before the order has been shipped by contacting our support team.
North Lucid ships to addresses within Canada only. All orders are shipped in discreet, unmarked packaging with no external indication of contents. Shipping times are estimates and are not guaranteed. Standard shipping typically takes 3-7 business days; express shipping takes 1-3 business days. North Lucid is not responsible for delays caused by Canada Post, weather, customs, or other circumstances beyond our control. Risk of loss and title for purchased items passes to you upon delivery to the shipping carrier. If a package is lost in transit, we will work with the carrier to investigate and, where appropriate, reship the order or issue a refund. When you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to: (a) provide accurate, current, and complete information during registration; (b) maintain and promptly update your account information; (c) notify us immediately of any unauthorized access or security breach; and (d) not share your account with any other person. North Lucid reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or is inactive for an extended period. You may delete your account at any time by contacting our support team.
North Lucid offers a loyalty rewards program, referral program, and promotional offers subject to additional terms. Reward points have no cash value and cannot be transferred, sold, or exchanged for currency. Points expire 12 months after the last qualifying activity. North Lucid reserves the right to modify, suspend, or terminate any rewards or promotional program at any time without prior notice. Abuse of promotional offers, including creating multiple accounts to exploit referral bonuses or discount codes, will result in account termination and forfeiture of all accumulated points and benefits.
All content on this Site, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of North Lucid or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws. The North Lucid name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of North Lucid. You may not use these marks without our prior written permission. You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only.

North Lucid does not provide medical advice and our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NORTH LUCID, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SITE OR PRODUCTS; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR PERSONAL INFORMATION; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE; OR (D) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE TRANSMITTED THROUGH THE SITE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.
You agree to indemnify, defend, and hold harmless North Lucid, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Site or products; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of the Site or products caused damage to a third party. This indemnification obligation will survive the termination of these Terms and your use of the Site.
These Terms shall be governed by and construed in accordance with the laws of Canada and the province in which North Lucid operates, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration in accordance with the rules of the Canadian Arbitration Association. The arbitration shall be conducted in English (or French, upon request) and the decision of the arbitrator shall be final and binding. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. These Terms, together with the Privacy Policy and Returns & Refund Policy, constitute the entire agreement between you and North Lucid regarding your use of the Site and supersede all prior agreements, understandings, and communications, whether written or oral.
